Terms, Policies, and Prices
Images: All images on this website are for reference only. Product images and the CDHORIZON Equipment logo may not be reproduced or copied without the written permission of CDHORIZON Equipment. Photos are for illustrative purposes only, and while they may indicate the type of part being purchased, the actual part may differ from the one shown in the photo.
Acceptance: All orders are subject to approval and acceptance by CDHORIZON Equipment. The following terms and conditions apply to all orders and are subject to change without notice. CDHORIZON Equipment reserves the right to cancel accepted orders if circumstances beyond its control (including but not limited to fire, flood, strikes, labor disputes, accidents, sabotage, terrorism, war, riots, transportation delays, or inadequate transportation facilities, legal restrictions, material shortages, and other similar circumstances) prevent the timely delivery of ordered products.
Prices: Prices are subject to change without notice. Unless otherwise stated, all prices are quoted in US dollars.
Payment Terms: Credit or debit card payments are accepted at the time of purchase.
Cancellation: Orders cannot be canceled once payment has been made.
General Returns: All returns must be requested within 90 days of the invoice date.
Returned items must have an issued Return Authorization (RA) number and must be accepted within
30 days of the RA issuance. All special-order products, electronics, paints, chemicals,
lubricants, LPG tanks, and fire extinguishers are non-returnable once ordered. Returned items
must be shipped prepaid to CDHORIZON Equipment.
A 25% restocking fee will apply to all returns, unless the return is due to an error in the
order or product by CDHORIZON Equipment.
Returned defective items will undergo comprehensive testing and inspection. For items verified
as defective, CDHORIZON Equipment will, at its discretion, repair or replace the item at no
charge, or provide a full refund (including shipping costs). If a returned defective item is
determined to be functional, testing fees and a 25% restocking fee per item will apply.
No refunds will be issued for items damaged by corrosive materials, abuse, modification, or
misuse.
Return Authorization Required: Before returning any item to CDHORIZON Equipment, a Return Authorization (RA) number must be obtained from your Sales/Customer Service department

Reason for return
Order number
Limitation of Liability: CDHORIZON Equipment shall not be liable for any special, incidental, consequential, indirect, or similar damages arising from breach of warranty, breach of contract, negligence, or any other legal theory, even if CDHORIZON Equipment or our agents have been advised of the possibility of such damages. Additionally, this means CDHORIZON Equipment is not responsible for any expenses arising from loss of profits or revenue. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you.
Taxes: The purchaser is responsible for all manufacturer taxes, sales taxes, use taxes, excise taxes, or other taxes or similar fees imposed by any government agency on the sale or use of the products sold. The purchaser agrees to reimburse CDHORIZON Equipment for all taxes, duties, or fees incurred by CDHORIZON Equipment as a result of the sale of products to the purchaser.
Waiver: CDHORIZON Equipment’s failure to insist on strict performance or fulfillment of any term or condition of this agreement shall not constitute a waiver of such term or condition, and CDHORIZON Equipment reserves the right to enforce such terms or conditions.
Governing Law/Exclusive Jurisdiction: These terms and conditions and the sale of goods under this agreement shall be governed by and construed in accordance with the laws of the State of Washington. The local courts of Whatcom County, Washington, shall have sole and exclusive jurisdiction over any disputes related to these terms and conditions and/or the sale of goods under this agreement, unless CDHORIZON Equipment (at its discretion) selects or explicitly agrees to another court. The purchaser hereby explicitly consents to the jurisdiction of the local courts of Whatcom County, Washington.
Export Control: The buyer acknowledges that all products and any related technology transferred by the seller are subject to U.S. export control and sanctions laws, regulations, and executive orders, including but not limited to the Export Administration Regulations (15 C.F.R. Parts 730-774), the International Traffic in Arms Regulations (22 C.F.R. Parts 120-130), and the Foreign Assets Control Regulations (31 C.F.R. Parts 500-598).
Under no circumstances may the buyer sell, lease, use, transfer, disclose, import, export, or re-export the products in violation of such applicable laws, regulations, orders, or requirements. The buyer hereby agrees not to transfer, export, or re-export the products and related technology without compliance with all applicable U.S. export control and sanctions laws, regulations, and executive orders. Export or re-export to parties denied export privileges or prohibited from engaging in export transactions is prohibited. Export or re-export to embargoed and sanctioned countries is prohibited unless authorized by the relevant U.S. regulatory agencies.
Violation of any U.S. export laws, sanctions, and regulations may result in the termination of this agreement by the seller, including any business arrangements or relationships with the buyer. If the buyer takes any action that results in a violation of applicable export controls or sanctions, the buyer agrees to indemnify, defend, and hold the seller harmless from any damages, liabilities, losses, costs, expenses, and fees (including reasonable attorney fees) arising from or related to such actions or omissions.
Severability: If any term or policy set forth in this agreement is deemed invalid, illegal, or unenforceable by a court of competent jurisdiction, such term or policy shall be enforced to the maximum extent permitted by applicable law, and the validity, legality, and enforceability of the remaining terms and policies shall not be affected or impaired.
