Terms, Policies and Pricing

Acceptance: All orders are subject to approval and acceptance by CDHORIZON. The following terms and conditions apply to all orders and are subject to change without notice. CDHORIZON reserves the right to cancel an accepted order if CDHORIZON is unable to deliver the ordered product on time due to circumstances beyond CDHORIZON's control, including but not limited to fire, flood, strikes, labor disputes, accidents, sabotage, terrorism, war, riots, transportation delays or inadequate transportation facilities, legal restrictions, material shortages, and other similar circumstances.
Prices: Prices are subject to change without notice.
Payment Terms: Purchases may be made by credit or debit card or international wire transfer.
Cancellations: Orders cannot be canceled after payment has been made.
General Returns: All returns must be made within 90 days of invoice issuance. Returns must be accompanied by an issued return authorization number and must be accepted within 30 days of issuance. All special order products, electronics, paints, chemicals, lubricants, LPG cylinders, and fire extinguishers are non-returnable once ordered. Returned merchandise must be returned to CDHORIZON freight prepaid. All returns (except those related to CDHORIZON orders or product errors) will be subject to a 25% restocking fee per item.
Defective merchandise returned will be fully tested and inspected. CDHORIZON will (at its sole discretion) repair or replace any merchandise verified as defective, free of charge, or provide a full refund for the defective merchandise (including shipping costs). Defective merchandise returned that is determined to be in working order will be subject to a testing fee and a 25% restocking fee per unit. Merchandise damaged by corrosive materials, abuse, modification, or misapplication will not be refunded. A Return Authorization Number must be obtained from your Sales/Customer Service Department before returning any merchandise to CDHORIZON.
Your request must include: 1. Part number and description 2. Reason for return 3. Order number
Limitation of Liability: In no event shall CDHORIZON be liable for special, incidental, consequential, indirect, or other similar damages arising from breach of warranty, breach of contract, negligence, or any other legal theory, even if CDHORIZON or our agents have been advised of the possibility of such damages. Furthermore, this means that CDHORIZON is not responsible for any expenses resulting from lost profits or revenue.
Taxes: Purchaser is responsible for all manufacturers', sales, use, excise, or other taxes or similar charges imposed by any governmental authority on the sale or use of the Products sold. Purchaser agrees to reimburse CDHORIZON for all taxes, duties, or charges incurred by CDHORIZON in connection with the sale of Products to CDHORIZON.
Waiver: CDHORIZON's failure to insist upon strict performance or performance of any term or condition of this Agreement shall not constitute a waiver of such term or condition, and CDHORIZON reserves the right to enforce such term or condition.
Governing Law/Exclusive Jurisdiction: These Terms and Conditions and the sale of goods hereunder shall be governed by and construed in accordance with the laws of the People's Republic of China. The People's Court of Jiading District, Shanghai shall have sole and exclusive jurisdiction to hear any dispute arising out of or relating to these Terms and Conditions and/or the sale of goods hereunder, unless CDHORIZON Equipment (in its sole discretion) selects or expressly consents to another forum. Purchaser hereby expressly consents to the jurisdiction of the People's Court of Jiading District, Shanghai.
Export Control: Buyer acknowledges that all products and any related technologies transferred by Seller are subject to China's export control and sanctions laws, regulations and administrative orders, including but not limited to the Export Control Law of the People's Republic of China, the Foreign Trade Law of the People's Republic of China, and the Regulations on the Administration of Technology Import and Export.
Under no circumstances will Buyer sell, lease, use, transfer, release, import, export, or re-export the Products in violation of any applicable laws, regulations, orders, or requirements. Buyer hereby agrees that it will not transfer, export, or re-export the Products and related technology except in compliance with all applicable Chinese export control and sanctions laws, regulations, and administrative orders. Export or re-export to parties that have been denied export privileges or prohibited from engaging in export transactions is prohibited. Export or re-export to embargoed and sanctioned countries is prohibited unless authorized by Chinese regulatory licensing authorities.
Violations of any Chinese export laws, sanctions, and regulations may result in the Seller's termination of this Agreement, including any business arrangement or relationship with the Buyer. If the Buyer takes any action that results in a violation of applicable export controls or sanctions, the Buyer agrees to indemnify, defend, and hold harmless the Seller from and against any damages, liabilities, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or related to the Buyer's actions or omissions.
Severability: If any provision or policy set forth in this Agreement is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision or policy shall nonetheless be enforced to the maximum extent permitted by applicable law, and the validity, legality, and enforceability of the remaining provisions and policies shall not be affected or impaired thereby.
Product Liability: The products sold are second-hand products. The buyer understands that the seller does not assume any responsibility for the quality of second-hand products sold. The specific product condition is subject to the condition at the time of shipment by the seller. The buyer promises to understand the actual condition of the purchased products before purchasing.
